Conditions of Use

General Information
In respect to business relations of all types between „Cans&co. - Paul Heus jr. „ (hereafter called C&C) and its customers, the following general terms and conditions of business hold true in their legally valid versions, respectively. Different conditions or general business practices of the customer have no legal validity unless a written agreement has been negotiated elsewhere.

All offers whether they be transacted by telephone, Internet, e-mail or in any other form only become legally binding for C&C if they have been confirmed in writing, or if the goods have been delivered and/or an invoice has been delivered.

C&C reserves the right to deny the promised service subsequent to determining that the goods are no longer available, both after contractual settlement and also  although a corresponding hedging transaction has been concluded. In such a case, the customer will be notified immediately. All reciprocations and considerations of any kind provided by the customer beforehand will be reimbursed without delay. It is then excluded that further legal claims be raised by the customer against C&C.

Contractual languages and contract conclusion
Contractual languages are German and English.

The products shown in the online shop are not a legal binding product offering but a non-binding online catalogue. By clicking the ordering button at the final step of the ordering process, the seller places a binding ordering of the chosen goods. After placing your order, C&C will send a confirmation by email to the customer that the order was received. The order confirmation does not yet constitute a binding contract of sale. It is merely for your information, to let you know that C&C have received your order. A binding contract of sale shall come into being when C&C confirms  the product shipping.

The terms and conditions for our wares are subject to change and non-binding.
The demonstration of our wares on the internet is not an offer, it’s non-binding request to customers to order. Technical and other changes to shape, colour and weight are reasonable.
By ordering the required goods, the customer defines the binding contract proposal.
We will confirm the receipt of the order immediately to the customer.
This receipt conformation is only describe an acceptance of the customers contract proposal if we declare this specifically.
C&C is entitled to accept the contract proposal within two weeks.
C&C is entitled to accept electronically placed orders within three weekdays after receiving the order. We have the right to deny an order examination the customers credit rating. We have the right to limit the order to a common usage amount.
The conclusion of a contract takes place under reserve. In case of not receiving deliveries in proper form by our suppliers, we are not obligated to process the order.
That only applies if it is not  maintainable by us that we did not receive deliveries from our suppliers. In case that the ordered goods are not or not completely available the customer will be informed immediately. The consideration will be refunded immediately.
If the customer ordered electronically the wording of the contract will be saved and forwarded to the customer per e-mail.back


Prices
All Prices are in Euro, including the German VAT (7% on books and magazines, 19% on all other items). You will charged the prices stated in our online-shop at the time your order has been placed. Prices do not include shipping. For sure C&C will give its very best to avoid any pricing errors, but if there are wrong prices shown, C&C has the right to refuse or cancel any incoming orders.

The pricings in our online shop include the regulated turnover taxes.

Shippping and handling is not included in those prices.

Payment options and shipping costs :

Shipping and Handling EUROPE
The costs for shipping and handling do not depend on the country you order from or the order value. The standard amount is 16,00 €

Shipping and Handling Outside EU
The costs for shipping and handling do not depend on the country you order from or the order value. The standard amount is 35,00 €

The payment has to be done in advance or with Paypal.

Cash in Advance
If you choose to prepay your order you have to transfer the order amount to our bank account before your order will be processed. We will send you our bank details once we have confirmed that your ordered items are available.

Paypal
You will be linked automatically to the paypal site in the checkout process, after you have placed an order.
It is always better to wait for our response mail before you pay, but if you have payed and we can´t sell you the item (out of stock) you will get the money payed back with paypal.


Minimum order value is 25,00 €. This does not include shipping costs.

Shipping information
Your order will be shipped within 3 to 5 weekdays. The order will be carried out by DHL (German Post Office). The payment has to be done in advance or with Paypal. Please do only accept packages if they’re unopened and do not show any signs of damage.

As soon as your order will be shipped you will receive a confirmation e-mail from us (only if you entered a valid e-mail address when you ordered).
Replacement or return revoke information
Customers can return their order within 2 weeks after receiving the order by returning the order. Customers can revoke their contract of sale in written text (e.g. e-mail, fax, letter) without naming any reasons within 2 weeks after the day the order has been shipped  To meet the deadline, timely mailing shall suffice ( the date stamp of the post office counts).

The right of revocation does not apply on orders of audio or video recordings and software if these have been unsealed or opened.


With effective execution of revocation the customer is obligated to send back the order.

In case of effective revocation, received performances (products / money) of both sides have to be returned. If you’re not able to return the received performances, or only parts of it, or in bad condition, you probably will have to pay compensation. If you tested the products like you would have been able to do so in a store, does not affect the right of returning them.
To avoid the duty of compensation, you should not do anything to affect the value of the products. Transportable products have to send back. If the delivered products are defective or they are not in accordance with what you have ordered, the warranty claim does not affect the right of revocation.


Warranty
On receiving the ordered items, the customer shall examine the goods in order to ensure that they are complete and that there are no defects. This examination shall be effected as soon as possible. Should a loss or defect be ascertained, the customer shall immediately serve a notice of defect.

The warranty period shall be a period of two years after the goods are delivered to the customer.

 In the case of defective goods, the customer is entitled to claim at his discretion either the removal of the defective part or delivery of a product which is free of defects. C&C is entitled to refuse the kind of replacement chosen by the customer, if the kind of replacement requires unreasonable expense.
Reservation of proprietary rights
All of our deliveries and performances occur under proprietary right. Until the delivered products have been paid for in full by the customer they remain the property of C&C

Data protection
C&C collects and stores customer data  for the process of ordering and delivering and also to provide you with information material in the future. The customer data are stored for the maintenance of a customer database for an indefinite period of time. C&C will not transfer this customer data to a third party.


Please note, that C&C own the rights of all photos and texts shown on our page.
Applicable law and jurisdiction
C&C runs the whole service (webshop, customer service and logistic) from Germany, German law therefore governs it and should any legal discrepancy occur, it will be dealt with in an German court of law.The application of the UN-Agreement on Contracts on the International Purchase of Goods of 11th April 1988 is excluded.
If the customer has not general legal jurisdiction in his/her country, has changed residence since the purchase contract was made or has a temporary residence in another country or his/her residence is not fixed/known at the time of the suit, C&C  will apply München as the jurisdiction for any disputes arising as a result of a contract.
